DECLARACIONES GENERALES

EL PARTICIPANTE, con la firma del presente Documento, declara y reconoce:

  • Haber decidido libre y voluntariamente hacer uso de bicicleta o carrito de golf en Puntacana Resort & Club (La Actividad Deportiva), por lo que reconoce que es responsable frente a PROMOCIONES SUKONAI, S.A.S. (SUKONAI) y sus empresas matrices, subsidiarias y relacionadas, por cualquier daño o perjuicio que pueda ocurrir a su persona o a los bienes de su propiedad por cualquier eventualidad, incidente o accidente que pueda ocurrir en esta y las demás actividades relacionadas con La Actividad Deportiva o realizadas durante la misma.
  • Hacer constar ser única y exclusivamente responsable de cualquier daño que ocasione a SUKONAI y sus matrices, subsidiarias o a terceros en su persona o en sus bienes, comprometiéndose a reparar los mismos y eximir de responsabilidad de toda naturaleza a SUKONAI y sus matrices, subsidiarias y/o relacionadas o a terceros en su persona o en sus bienes.
  • Descargar y eximir a SUKONAI y sus empresas matrices, subsidiarias y/o relacionadas de cualquier responsabilidad frente a terceros ante cualquier daño sufrido en razón del uso de la bicicleta o carrito de golf durante la realización de La Actividad Deportiva.
  • Asumir la responsabilidad y obligación de cumplir con las normas y procedimientos de seguridad que disponga SUKONAI o quien ésta designe, a fin de preservar el orden, la privacidad y la seguridad de las instalaciones donde se ejecute La Actividad Deportiva, así como cumplir con las precauciones y normas establecidas por la administración de los equipos, incluyendo de manera meramente enunciativa pero no limitativa las siguientes:
    1. Al realizar La Actividad Deportiva debe permanecer en todo momento dentro de los límites de la zona destinada y delimitada a los fines. Está prohibido conducir la bicicleta o carrito de golf en la avenida principal o fuera de las instalaciones del Puntacana Resort & Club.
    2. El uso de casco es opcional de EL PARTICIPANTE y conforme disponibilidad de SUKONAI.
    3. Está prohibido el consumo de bebidas alcohólicas, uso de botellas de vidrio y mascotas, durante La Actividad Deportiva.
    4. Los menores de edad deben estar siempre acompañados y bajo la responsabilidad y vigilancia de un adulto.
    5. Cualquier daño ocasionado al carrito de golf o a la bicicleta propiedad de SUKONAI y sus empresas matrices, subsidiarias y/o relacionadas será cargado a la cuenta de EL PARTICIPANTE, en su calidad de huésped del hotel The Westin Puntacana Resort & Club.

DECLARACIONES ADICIONALES

EL PARTICIPANTE reconoce y acepta:

  • Que algunos riesgos inherentes asociados con el ciclismo y conducción de carritos de golf incluyen caídas y contacto con otros ciclistas y defectos latentes o aparentes en el equipo o propiedad, y actos negligentes pasivos o activos de mí mismo, por lo cual, mediante este Documento mantiene indemne a SUKONAI y sus matrices, subsidiarias y/o relacionadas.
  • Que libera de responsabilidad a SUKONAI y sus matrices, subsidiarias y/o relacionadas ante cualquier daño incurrido como resultado de cualquier enfermedad o incapacidad que pueda sufrir, incluyendo los costos de la atención médica o de cualquier lesión o daño a la persona o bienes de los demás que pueda causar, o de cualquier responsabilidad u obligación económica que pueda incurrir personalmente a causa de su solicitud.
  • Que este Documento sea oponible a los miembros de su familia y al cónyuge sobreviviente y sus herederos, cesionarios y representante personal.
  • Que en caso de fallecimiento de EL PARTICIPANTE, este Documento se considerará como un descargo, renuncia y finiquito como acuerdo de no iniciar acción legal alguna contra SUKONAI y sus matrices, subsidiarias y/o relacionadas, toda vez que el presente, se ha hecho con pleno conocimiento de los posibles riesgos y peligros involucrados derivados de La Actividad Deportiva.
  • Que este Documento se interpretará de conformidad con las leyes de la República Dominicana.
  • Ser mayor de edad en su estado y/o país de residencia y plenamente competente, y ejecuta voluntariamente este Documento para su total, adecuada y completa consideración.
  • Haber leído, entendido y aceptado las declaraciones anteriores.
  • EL PARTICIPANTE reconoce y acepta que este Acuerdo es firmado y deberá ser ejecutado en idioma español. En el caso de que a requerimiento de EL PARTICIPANTE y por razones de traducción requiera éste una versión en idioma inglés u otro, podrá ser realizada dicha versión con una traducciónrealizada por un intérprete judicial, a la versión en español de este Documento en todos sus aspectos. En caso de conflicto entre las versiones en dos idiomas de este Acuerdo, queda acordado entre EL PARTICIPANTE y SUKONAI que las disposiciones establecidas en la versión español prevalecerán.

USE OF GOLF CARTS OR BICYCLES
REGISTRATION AND CONSENT FORM

GENERAL STATEMENTS

THE PARTICIPANT, by signing this document, declares and acknowledges:

  • To have freely and voluntarily decided to make use of a bicycle or golf cart at the Puntacana Resort & Club (Sports Activity), and therefore acknowledges that he/she is liable to PROMOCIONES SUKONAI, S.A.S. (SUKONAI) and its parent companies, affiliate companies and/or subsidiaries, for any personal injury or property damages caused by any possible eventuality, incident or accident when performing this and any other activities related to or during the Sports Activity.
  • That he/she is exclusively responsible for damages or personal injury of any kind incurred by SUKONAI, its parent companies, affiliate companies, subsidiaries and/or third parties with regards to person or property, undertaking to repair damages caused and release SUKONAI and its parent companies, affiliate companies, subsidiaries and/or third parties from any and all liability.
  • To release and hold SUKONAI, its parent companies, affiliate companies and/or subsidiaries harmless from damages incurred by third parties arising from the use of bicycles or golf carts during the performance of Sports Activity.
  • That he/she undertakes to comply with any safety standards, policies or procedures made available by SUKONAI or its appointee to preserve the order, privacy and security of facilities where the Sports Activity is carried out, and comply with all precautions and regulations set forth by management with regards to the equipment used, including but not limited to the following:
    1. When carrying out the Sports Activity, individual must remain within the area set forth for such purposes at all times. Driving abicycle or golf cart on the main avenue or outside the Puntacana Resort & Club facilities is strictly forbidden.
    2. Wearing a helmet is optional for PARTICIPANT and subject to SUKONAI availability.
    3. Pets, alcohol consumption and glass bottles are strictly forbidden during the Sports Activity.
    4. Minors must always be accompanied by an adult and are the responsibility of the accompanying adult.
    5. Damages to golf carts or bicycles owned by SUKONAI, its parent companie

ADDITIONAL STATEMENTS

PARTICIPANT acknowledges and agrees:

  • Risks inherent to cycling and the operation of a golf cart include falling of the bicycle and collisions with other cyclists, machine / equipment breakdown, latent or obvious defects and passive or active negligence on PARTICIPANT’s part. PARTICIPANT therefore hereby holds SUKONAI, its parent companies, affiliate companies and/or subsidiaries harmless.
  • To release and hold SUKONAI, its parent companies, affiliate companies and/or subsidiaries harmless for damages incurred as a result of any illness or disability, (including medical costs) or for any personal injury or damages to third party property, or any liability or financial obligation that may be personally incurred as a result.
  • This document is enforceable against family members, the surviving spouse, heirs, assignees and personal representative.
  • That, in the event of PARTICIPANT’s death, this document shall be deemed a release, waiver and settlement agreement not to initiate any legal action against SUKONAI, its parent companies, affiliate companies and/or subsidiaries, provided PARTICIPANT has signed this document with full knowledge of potential risks and hazards associated with Sports Activity.
  • This document shall be construed pursuant the laws of the Dominican Republic.
  • To have attained the legal age of majority and full legal capacity in PARTICIPANT’s state and/or country of residence, and to voluntarily execute this document for full, adequate and complete consideration.
  • Having read, understood and accepted the above statements.
